1. Who We Are
Pathfinder is provided by Pathfinder the way out, 201 rte de Razac D'Eymet, Fonroque, 24500, France ("Pathfinder", "we", "us", "our"). You can contact us at [email protected].
By accessing the Website, purchasing a course or module, joining the community, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
2. What Pathfinder Is (and Isn't)
Pathfinder is an educational and personal development programme. It is built around a structured system of self-understanding, drawing on frameworks including the Hawkins Scale of Consciousness, Jungian depth psychology and Cluster B personality dynamics.
Stewart's guidance is offered on the basis of his own lived experience and study, not as a licensed therapist, doctor or clinician. If you are in crisis, experiencing thoughts of harming yourself or others, or dealing with an active safeguarding concern, please contact emergency services or a qualified professional in your country without delay.
If you are managing a chronic health condition, are in an unsafe living situation, or are working through a diagnosed mental health condition, we strongly encourage you to use Pathfinder alongside appropriately qualified support, not instead of it, and to make your own informed decisions about what is right for you.
You use the Services, and apply anything you learn through them, at your own discretion and own risk.
3. Eligibility
You must be at least 18 years old to purchase or use the Services. By using the Services, you confirm that you are 18 or over and that you have the legal capacity to enter into these Terms.
Some community spaces are organised around specific lived-experience streams (for example, survivors of abuse, chronic health conditions). These groupings are for relevance and safety, not a clinical assessment, and we reserve the right to move, restrict or decline access to any group at our discretion.
4. Your Account
- You are responsible for keeping your login details confidential and for all activity under your account.
- You must provide accurate, current information when registering and keep it up to date.
- Accounts are personal to you and may not be shared, transferred or sold.
- We may decline to register an account, or ask for additional verification, at our discretion.
- We may suspend or close an account that we reasonably believe is being used fraudulently, abusively, or in breach of these Terms.
5. Courses, Modules and Digital Products
Pathfinder is structured as sequential modules, available for individual purchase or as a full-journey bundle, with a free entry-level module. Some products may be marked as "coming soon" or waitlist-only and are not available for purchase until formally launched.
- When you purchase a course or module, we grant you a personal, non-transferable, non-exclusive licence to access that content for your own private use.
- You may not share your login, resell, redistribute, publicly perform, or otherwise make available any course content to third parties.
- Access to sequential modules may be granted automatically upon completion of prior modules, rather than on a fixed release schedule; timing may vary based on your pace.
- We may update, improve or restructure course content over time. We will try to preserve the substance of what you purchased, but exact lesson structure is not guaranteed to remain identical indefinitely.
6. Community Access
Some Services include access to community spaces (including free and paid tiers). Community access is a privilege, not a guaranteed right, and is governed by the community guidelines referenced in Section 10.
- Community access levels are tied to your purchase or membership status and may be adjusted if that status changes (for example, on cancellation or non-payment).
- We may moderate, remove content from, or restrict access to community spaces at our discretion, particularly where safety, wellbeing or these Terms are at issue.
7. Pricing and Payment
- All prices are shown in euros (EUR) and are inclusive/exclusive of applicable taxes as indicated at checkout.
- Payment is processed securely through our payment provider(s) via Kajabi; we do not store your full card details.
- Where a product involves instalments or recurring billing, you authorise us to charge your chosen payment method on the agreed schedule until the balance is paid in full or the subscription is cancelled.
- We may change prices for future purchases at any time. Changes will not affect a course or module you have already purchased.
8. Cancellations and Refunds
- If you have not yet accessed a paid module, you can contact us within 48 hours of purchase and we will consider a refund at our discretion.
- If you are a consumer based in the UK or EU purchasing at a distance, you may have a statutory right to cancel within 14 days of purchase under consumer protection law. Because our digital content is available to you immediately on purchase, we will ask you to expressly agree at checkout to receive it straight away and to acknowledge that this means you lose that statutory cancellation right, in line with UK and EU digital content rules.
- Community membership subscriptions may be cancelled at any time. Cancellation takes effect at the end of the current billing period, and we do not refund the remainder of a paid period unless required by law.
- The full-journey bundle and referral rewards are calculated on the bundle as purchased. Partial refunds of a bundle are handled at our discretion on a pro-rata basis.
This section does not affect any statutory rights you may have that cannot be excluded under the law of your country of residence.
9. Referral Programme
Where offered, Pathfinder's referral programme allows existing customers to earn a reduction against their own course investment for successful referrals. The current reward rate and how many referrals are needed to cover your full journey cost are set out on the relevant programme page on the Website, not in these Terms, as they may change from time to time.
- Referral rewards are calculated only on completed, non-refunded purchases by the referred person.
- Referral rewards are not exchangeable for cash and may only be applied against Pathfinder products, unless we state otherwise.
- We may amend, pause or withdraw the referral programme, or disqualify referrals we reasonably believe involve abuse of the system (for example, self-referral or fraudulent sign-ups), at our discretion.
10. Acceptable Use and Community Guidelines
Given the nature of this community, we ask everyone to engage with honesty, respect and care for others who may be in a vulnerable place. When using the Website, community spaces, or any interactive area, you agree not to:
- Harass, threaten, abuse or demean any other member or member of staff;
- Share another person's personal information without their consent, or disclose details that could identify a member of a specialist stream (for example, abuse survivors) without their agreement;
- Post content that is unlawful, defamatory, or that promotes violence, hatred or discrimination;
- Give clinical, medical or legal advice to other members, or represent yourself as a qualified professional unless you are one;
- Attempt to access another member's account, scrape or resell course content, or circumvent access controls;
- Use the Services for any unlawful purpose.
We may remove content, suspend accounts, or restrict access for conduct that breaches this section, without refund where the breach is serious.
11. Your Content and Testimonials
If you post in community spaces, submit a testimonial, or otherwise share content with us ("User Content"), you retain ownership of it, but grant Pathfinder a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that content for the purposes of operating and promoting the Services, unless you tell us otherwise and we agree in writing.
Given the sensitive nature of some shared experiences, we will always seek your specific, separate consent before using anything you share (including in community spaces or specialist streams) in public-facing marketing, and you may withdraw that consent at any time.
12. Intellectual Property
All course materials, written content, video, audio, branding, and the structure and design of the Website and programme are owned by Pathfinder (or licensed to us) and protected by copyright and other intellectual property laws. Except for the limited licence granted to you to access purchased content for personal use, nothing in these Terms transfers any intellectual property rights to you.
13. Third-Party Links and Content
The Website and community spaces may contain links to third-party websites or reference third-party frameworks and ideas. We do not endorse and are not responsible for third-party content, and your use of any linked site is at your own risk and subject to that site's own terms.
14. Disclaimers
The Services are provided "as is" and "as available". To the fullest extent permitted by law, we exclude all warranties, express or implied, as to the accuracy, completeness, or fitness for a particular purpose of the Services, and we do not guarantee any specific personal, emotional, or health outcome from using Pathfinder.
Personal development outcomes depend on individual circumstances, effort and context, and results will vary between individuals.
15. Limitation of Liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot lawfully be limited or excluded.
Subject to the above, to the fullest extent permitted by law, Pathfinder's total liability to you arising out of or in connection with the Services, whether in contract, tort or otherwise, is limited to the amount you paid for the specific product or service giving rise to the claim in the 12 months before the claim arose. We are not liable for indirect, special or consequential loss.
16. Indemnity
You agree to indemnify and hold Pathfinder harmless against reasonable losses, damages and costs arising from your breach of these Terms or misuse of the Services, except to the extent caused by our own negligence or breach.
17. Privacy and Data Protection
We process personal data in accordance with our Privacy Policy, available at pathfinderthewayout.com/privacy-policy. Given the sensitive nature of some community content (for example, disclosures relating to abuse or health conditions), we take extra care with how this information is stored, who can access it, and how long we retain it. Full detail is set out in the Privacy Policy rather than repeated here.
18. Changes to These Terms
We may update these Terms from time to time, for example to reflect changes in the Services, legal requirements, or how we operate. We will post the updated Terms on the Website with a revised "last updated" date, and where changes are material, we will make reasonable efforts to notify existing members by email. Continued use of the Services after changes take effect means you accept the updated Terms.
19. Suspension and Termination
You may stop using the Services and close your account at any time. We may suspend or terminate your access, with or without notice, where you materially breach these Terms, where required by law, or where we reasonably believe your continued access poses a risk to Pathfinder, our staff, or other members.
20. Governing Law and Disputes
These Terms are governed by French law, and any dispute not resolved informally falls under the jurisdiction of the French courts, reflecting Pathfinder's place of business.
If you are a consumer, nothing in this section deprives you of any mandatory protections available to you under the law of the country in which you are resident.
We would always prefer to resolve a disagreement directly. If something isn't right, please contact us first at [email protected] before pursuing a formal dispute.
21. General
- Entire agreement: These Terms, together with any Privacy Policy and specific product terms shown at checkout, form the entire agreement between you and Pathfinder regarding the Services.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.
- No waiver: Our failure to enforce a provision is not a waiver of our right to do so later.
- Assignment: You may not transfer your rights under these Terms without our consent; we may assign these Terms in connection with a transfer of our business.
